TERMS OF SALE
1. Overview
These Terms of Sale govern all purchases of products made through runningoat.com, operated by Runningoat – Entreprise individuelle, 108 Parc des Sources, 93220 Gagny, France, SIRET 84173118500028. By placing an order on this website, you agree to these Terms of Sale.
2. Products
Products offered for sale are those displayed on the website at the time of viewing, subject to availability. Essential product characteristics are described on each product page. Product images are provided for illustration only and are not contractually binding.
3. Pricing and VAT
All prices are displayed in the currency selected on the website and are shown inclusive of any applicable taxes and exclusive of shipping fees unless otherwise stated. VAT is not applicable under article 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI). Runningoat reserves the right to change prices at any time; orders are charged at the price in effect when the order is placed. Any customs duties, import taxes or handling fees charged by the destination country are payable by the customer and are not included in the price of the order.
4. Orders
You place an order online through the shopping cart and checkout process. Your order constitutes an offer to purchase. The contract is formed when we send you an order confirmation by email. We reserve the right to refuse or cancel an order, in particular in the event of a pricing error, suspected fraud or unavailability of the product.
5. Payment
Payment is processed online through the payment methods displayed at checkout. All transactions are secured. Orders are processed after full payment confirmation.
6. Shipping and delivery
Products are shipped to the address provided at checkout. Shipping is free on all orders. Estimated delivery time is 9 to 14 business days from the date of shipment. Delivery times are estimates and may be affected by carrier disruptions or circumstances beyond our control. Full details are set out in our Shipping Policy.
7. Returns and right of withdrawal
Wherever you are located, you may return your order within 30 days of delivery under the conditions set out in our Refund Policy. In addition, consumers resident in the European Union have a statutory right, under articles L.221-18 and following of the French Consumer Code, to withdraw from their purchase within 14 days of receiving the goods, without giving any reason; our 30-day policy is more generous and does not reduce that right.
8. Returns and refunds
Returns are accepted within 30 days of delivery. Products must be returned unused, in their original packaging and with tags attached. Return shipping is covered by Runningoat, which provides a prepaid return label. Refunds are issued to the original payment method within 14 days after we receive and inspect the returned item. 9. Legal warranties
As we sell from France, all products benefit from the legal guarantee of conformity (articles L.217-3 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the French Civil Code). These guarantees apply in addition to any mandatory consumer rights you hold in your own country of residence. To make a claim under these guarantees, contact us at contact@runningoat.com.
10. Liability
Runningoat cannot be held liable for damage resulting from misuse of a product or from circumstances beyond its reasonable control. Nothing in these Terms of Sale limits the rights consumers have under mandatory French or European law.
11. Mediation and dispute resolution
In accordance with articles L.612-1 and following of the French Consumer Code, consumers may refer a dispute to a consumer mediator free of charge. The European Commission also provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
12. Governing law
These Terms of Sale are governed by French law, as Runningoat is established in France. This does not deprive consumers of the protection afforded by the mandatory consumer law of their own country of residence, and consumers may bring proceedings before the courts of their place of residence.
